By using this Site you accept these terms of use as from the date you first access this Site. Comic Relief may modify these terms of use at any time by updating the text of this page, so please check back regularly.

Definitions

In these terms of use, the following words have the following meanings:

"Content" means all content on this Site, including all information, graphics, trade marks, logos, designs, text, photos, films, sounds, software and applications;

"Contribution(s)" means anything that a user posts on this Site or sends to Comic Relief, including any photographs, video or audio clips, comments or posts or competition entries;

"Site" means any website which Comic Relief owns or controls, and from which a link has been created to these terms of use;

"these terms of use" means the terms of use set out below, as well as our Privacy Policy and any other terms and conditions on this Site; "you", "your" and "yours" means a person(s) accessing this Site.

Content

This Site and all the Content on it is owned by Comic Relief (or its licensors and content providers). All rights in the Content are reserved to their respective owners, unless expressly stated otherwise.

Any Contribution you send or post to this Site remains your property, but Comic Relief may use your Contribution as described under "Your Contributions" below. You may not use any Content on this Site unless it is expressly stated that you may do so. Where we state that it is permitted to do so, you may download and use Content, but only for the purposes of raising awareness about Comic Relief.

You may not:

  • use any Content on this Site for personal gain, for any commercial purpose, to advertise or sell any products or services, or to promote a business;
  • copy, transmit, store or distribute any part of this Site, unless we have expressly indicated that you may do so. You may not alter, modify, adapt, reverse engineer, disassemble or create derivative works of any software which is accessible through this Site; or
  • collect or use any personal details from this Site.

Your Contributions

If you send or post any Contributions to this Site or to Comic Relief, you confirm that you are granting Comic Relief a perpetual (and irrevocable), royalty-free, worldwide, non-exclusive licence to use the material in your Contribution for any purpose in any media in any part of the world. This includes the right for Comic Relief to copy, edit, publish, grant sub-licences, and exercise all other copyright and publicity rights over the material. You also waive all ‘moral rights’ in the materials (‘moral rights’ are described in the Copyright, Designs and Patents Act 1988).

If you do not wish to grant us these rights, please do not send or post your Contribution to this Site or to Comic Relief.

You must not post or send any Contributions to this Site or to Comic Relief that you do not have permission to publish or share in this way, for example clips of music videos or TV shows. By sending or posting a Contribution to this Site or Comic Relief you warrant that:

  • your Contribution does not infringe any person’s intellectual property rights, which include any copyright, moral rights or trade mark rights;
  • you have all the necessary rights to post or submit the Contribution and to grant us the rights described in the these terms of use; and
  • you have necessary permission from everyone in a picture or video. For children and young people the permission must be from their parent or legal guardian.

You should always give careful consideration before making public any personal information about yourself or anyone else (for example telephone number, home address or email address), especially anything that could identify a child or young person.

Comic Relief does not endorse any Contribution or any opinion, statement, or advice expressed by users of this Site. To the fullest extent permitted by law, Comic Relief expressly disclaims all liability in connection with any Contributions made by users of this Site.

Unlawful Use

You may only use this Site for lawful purposes and you agree to comply with all applicable laws, regulations and codes of conduct and to be solely responsible for all things arising from your use of this Site. You may not submit, publish, post, distribute or transmit any defamatory, offensive, infringing, obscene, indecent or unlawful or objectionable Contributions. You may not interfere with anyone’s use or enjoyment of this Site, for example by threatening, bullying or sending junk mail.

If Comic Relief in its sole discretion considers that any Contribution, conduct or use of this Site breaches these terms of use or is unlawful or inappropriate in any way, we reserve the right to do any or all of the following actions (without prior notice): (a) warn you via email and require you to discontinue such conduct or use; (b) delete any Contribution you have posted to this Site or which features in any personal area; (c) discontinue your registration with this Site or any service being provided; and/or (d) take other measures, including terminating, suspending or restricting use of this Site, and/or passing details to relevant third parties, including email providers, the police or other authorities. Any action that we take is without prejudice to any of our accrued rights.

Registration and Passwords

If you register with us and are asked to provide a password, you agree:

  • to keep your password secure and confidential and not allow anyone else to use your email address or password to access this Site;
  • to notify Comic Relief immediately if you become aware of any improper or unauthorised use of this Site or your details or your password:
  • not to do anything which would assist anyone who is not a registered user to gain access to any password-protected area of this Site; and
  • not to create additional registration accounts for the purpose of abusing the functionality of the Site, or other users, or to seek to pass yourself off as another user.

Rules for Using the Giving Pages and Fundraiser Showcase

In addition to our website Terms of Use, you must follow these rules when you use Sport Relief Giving Pages or the Fundraiser Showcase pages:

  • You may only use the Giving Pages to fundraise for Sport Relief/Comic Relief.
  • You must not advertise, sell anything or promote a business other than for fundraising.
  • You must not use inappropriate user names, passwords or page names.
  • Anything you post must be civil, polite, tasteful and appropriate.
  • Anything you post must not be unlawful, inappropriate or objectionable - this includes anything obscene (e.g. violent or sexually explicit), defamatory, or that someone else might find offensive, upsetting, abusive, or threatening.
  • You must not behave disruptively, offensively or abusively – this includes threatening, bullying, harassing or revealing personal details about someone else without their permission.
  • Please make sure you have permission from everybody appearing in pictures that you post. This is especially important for children under 16 – you should have the express permission of their parent or guardian, and should consider whether it’s appropriate to post the material at all.
  • Please do not post anything which is copyrighted, such as music videos or TV shows, and which you don’t have permission to use.
  • If you are not the child’s parent/guardian and wish to enter them into a Sainsbury’s Sport Relief Games event and set them up with a Giving Page, please ensure you have permission from their parent/guardian to do so.
  • If supporters aged under 16 wish to set up their own Giving Page, which is not part of a Sainsbury’s Sport Relief Games event, they must have their parent/guardian’s permission to do so and to supply their email address. We recommend that all fundraising is supervised by a responsible adult.
  • Under 16s with a Giving Page must only use the Facebook functionality if they are 13 years old or over.  It is important that they have the appropriate privacy settings on Facebook before sharing anything on their Giving Page.
  • The views expressed on the Giving Pages and the Fundraiser Showcase pages are those of members of the public, and not necessarily those of Comic Relief.
  • Under 16s must have their parent/guardian’s permission to use the Fundraiser Showcase.

Instagram and Twitter "The Great Sport Relief Bake Off" Competition

  • By entering this free prize draw, you agree to be bound by these terms and conditions. 
  • To enter this prize draw, you must be a UK resident and aged 16 or over. 
  • You may enter via Twitter or Instagram. The entrant should publically share a photograph of a run, swim or cycle themed cake. The entrant must tag @sportrelief and include the hashtag #GBBOSRStarBaker to be eligible for entry. 
  • Entry opens at 00:01 on Tuesday 7th January 2014. The closing date for entries is 21:00 on Thursday 16th January 2014. 
  • The winner will be drawn by an independent judge from all entries, and the cake that is deemed to illustrate the theme the best will be the winner. The judge’s decision will be final and no correspondence will be entered into.
  • The winner will be announced by Friday 17th January 2014 and contacted via Twitter or Instagram. The winner will then be requested to supply further contact details via direct message on Twitter or privately via email. If we cannot contact the winner after fourteen days, we may award the prize to another entry drawn at random.
     
  • We may use the winner’s names and photographs for promotional and publicity purposes and by entering the competition you agree to this use. Please see our privacy policy at www.sportrelief.com as well as these Terms of Use.
  • The prize is a ‘Great Sport Relief Bake Off’ apron, signed by Mary Berry and Paul Hollywood. The prize will de delivered to the winner by post.
  • The prize is non-transferable and there is no cash alternative. Comic Relief may substitute alternative prize of similar value.  Failure to claim the prize by the time or in the manner specified by Comic Relief will make any claim invalid.  
  • Comic Relief may disqualify you from winning a prize if it has reasonable grounds to suspect that you are in breach of these rules or your participation in the prize draw is fraudulent or otherwise unlawful.
  • This prize draw is not open to employees or contractors of Comic Relief (or anyone else involved in organising the competition) or their direct family members.
  • Comic Relief may cancel the prize draw for reasons outside of its reasonable control. Comic Relief may amend these rules without notice, by posting changes to them on this website.
  • Comic Relief does not accept any responsibility for any network congestion, technical failure or other problem in any telephone line, network, system, provider or otherwise which results in any communication not being properly recorded or received.

Nothing in these terms of use shall exclude or limit any liability for death or personal injury arising from negligence, or for any other liability which cannot be excluded or limited by law.

You agree that you are solely responsible for your use of this site, and that to the fullest extent permitted at law, Comic Relief, its officers, trustees, employees and agents do not make any representations and do not give any warranties, express or implied, concerning this Site and the Content. In particular, Comic Relief does not warrant or represent that this Site or the Content is virus free.

All software provided by third parties (for example Acrobat Reader and RealPlayer) is the sole responsibility of that third party.

Donations and Sponsorship

If you wish to donate to Comic Relief or sponsor anyone raising money for Comic Relief, please note that your donation or sponsorship is non-refundable. If you sponsor someone to do any activity for Comic Relief, your sponsorship is not conditional on the activity being completed.

Indemnity

You agree to indemnify Comic Relief (and its group companies, officers, trustees, employees and agents) from all claims, loss, damages, costs and expenses arising in connection with your use of this Site, or your breach of any of these terms of use, or any Contribution made by you (or through your account) on this Site. This obligation shall survive the end of these terms of use and your use of this Site.

Third Party Websites

This Site may contain links to websites operated by parties other than Comic Relief. Such links are provided for your convenience only and you access these links at your own risk. Comic Relief is not responsible for the content of any third party websites linked to or from this Site.

General Provisions

If any provision of these terms of use is deemed to be invalid by a court of competent jurisdiction, this shall not affect the validity of the remaining provisions, which shall remain in full force and effect. Any failure or delay by Comic Relief in asserting any of its rights or of any provision of these terms of use shall not constitute a waiver of such right or provision. Comic Relief reserves the right at its sole discretion to discontinue or amend any aspect of this Site at any time.

Governing Law and Jurisdiction

These terms of use shall be governed by and construed in accordance with English Law and you agree to submit to the exclusive jurisdiction of the English courts.

Comic Relief is a charity registered in England, Wales and Scotland and its fundraising activities are directed at the United Kingdom only.

Sainsbury’s Sport Relief Games Participants Terms and Conditions.

Sainsbury’s Sport Relief Mile:

By taking part in the Sainsbury’s Sport Relief Mile you agree and acknowledge the following terms and conditions:

  • Mile entry fees are non-refundable;
  • Your name and any image of you taken during your Mile event may be used in any publicity materials for Comic Relief and in any TV or other media coverage of the event. Information about use of names and images of under 16’s can be found in the Safety Tips for Parents/Guardian and Online Safety Tips;
  • Comic Relief does not accept responsibility or liability for any loss or damage arising out of your participation in the Sainsbury’s Sport Relief Mile, including liability as a result of negligence, except for death or personal injury caused by Comic Relief.

Under 16yr olds:

  • Under 16yr olds must have their parent or guardian’s permission to enter Mile events;
  • If you are registering a person under 16yrs old for a Mile event, you must be their parent or guardian, or their parent or guardian must have given you permission to enter the under 16yr old and have read these terms and conditions and the declaration at the end of the Mile registration process;
  • Under 16yr olds must be accompanied at Mile events by a responsible adult;
  • Parents or guardians who consent for an under 16yr old to use a Sport Relief Giving Page or do other fundraising activities should read the Safety Tips for Parents/Guardians and Online Safety Tips.

Sainsbury’s Sport Relief Cycle:

By taking part in the Sainsbury’s Sport Relief Cycle you agree and acknowledge the following terms and conditions:

  • Cycle entry fees are non-refundable;
  • The Sainsbury’s Sport Relief Cycle events are bicycle only events. Tandems are acceptable but motorised scooters or any other type of transport will not be accepted;
  • Bicycles will not be provided for the Cycle events, participants must bring their own.
  • You must ensure your bicycle is roadworthy and that you understand the rules of the Highway Code.
  • You agree to follow the instructions of marshals and officials at the Cycle events;
  • Your name and any image of you taken during your Cycle event may be used in any publicity materials for Comic Relief and in any TV or other media coverage of the event;
  • Comic Relief does not accept responsibility or liability for any loss or damage arising out of your participation in the Sainsbury’s Sport Relief Cycle, including liability as a result of negligence, except for death or personal injury caused by Comic Relief.

Under 16yr olds:

  • Under 16yr olds may enter the Family Cycle event only;
  • Under 16yr olds must have their parent or guardian’s permission to enter the Family Cycle event;
  • If you are registering a person under 16yrs old for a Cycle event, you must be their parent or guardian or their parent or guardian must have given you permission to enter the under 16yr old and have read these terms and conditions and the declaration at the end of the Family Cycle registration process;
  • Under 16yr olds must be accompanied at the Family Cycle event by a responsible adult;
  • Parents or guardians who consent for an under 16yr old to use a Sport Relief Giving Page or do other fundraising activities should read the Safety Tips for Parents/Guardians and Online Safety Tips.

Event Participants   

If you are taking part in the Sainsbury’s Sport Relief Games, or any other activity or event for Sport Relief, please remember to:

  • Prepare and train properly for your activity.
  • Warm up and cool down properly before and after an event.
  • Seek medical advice if you have any doubts about your ability to take part in an activity.
  • Take particular care if you are undertaking intensive physical activity of a type, or at a level you are not accustomed to.
  • Always be aware of the safety of other competitors, spectators and the general public.

If you’re planning on taking part in an ‘extreme’ sporting activity, consider whether you need professional instructors or guides to help you.

If you’re using our Sport Relief Giving Pages, here are a few safety tips to keep in mind:

Guidance for adults with a Sport Relief Giving Page:

  • A good password is an important part of staying safe online so choose one that’s hard to guess but easy to remember. 
  • Please give careful consideration before posting any personal details such as your address, phone number or photographs as they may be visible to all users. 
  • You should not post personal information about anyone else without their permission. This includes photographs or films of other people. 
  • Please give special consideration before posting information, photographs or films of children. You should have the express permission of their parent or guardian and should consider whether it’s appropriate to post the material at all. See our Safety Tips For Parents/Guardians for more details. 
  • If you see any material on the Giving Pages which you find offensive, please email us at fundraising@comicrelief.com and we will investigate it. 
  • We recommend you read and understand our privacy policy which applies to the information collected on the Giving Pages. 

Guidance for parents/guardians of Under 16s with a Sport Relief Giving Page:

  • Giving Pages for under-16s can’t be found through any search on sportrelief.com.  However, your child can email the direct link of their page to their friends and family so that they can sponsor them directly.  Please ensure that they only send the link to people they know and trust.  
  • Please note that content on the Giving Pages is not checked by Comic Relief before being posted. Your child’s Giving Page is in their control and you should take care that children don’t upload too much information about themselves, particularly contact and location information. 
  • Under-16s are able to share their Page and fundraising messages through Facebook.  It is important that your child has the appropriate privacy settings on Facebook.
  • We only ever request and contact the email address of an adult (we will only use this email address to communicate specifically about the U16 Giving Page). 
  • Remember the Giving Pages terms of use also apply.

Safety Tips For Parents/Guardian

If your child would like to fundraise for Sport Relief, here are a few safety tips to keep in mind:

  • Please make sure your child understands that they need your permission before they start any fundraising.
  • We recommend that a responsible adult properly supervises children under the age of 16 who are involved in fundraising.
  • We recommend that children don’t approach strangers to ask them for money or to get involved in their fundraising activity.
  • Please always take care when publishing any information about children, in particular their surname, school name, home address, or photo to ensure that under-16s are not easily identifiable.
  • Always check with other parents/guardians before you involve their children in fundraising, especially if their activity is being photographed or filmed.
  • We recommend that an adult looks after any money that is collected, and is responsible for paying the money to us. We don’t recommend that children pay us money directly or send us their details.
  • The best way for your child to fundraise is by setting them up with their own Sport Relief Giving Page, which we have specifically tailored for under-16s. You will also be asked if you want to set up an under-16 Giving Page if you enter an under-16 into a Sainsbury’s Sport Relief Games event.  Giving Pages for under-16s can’t be found through any search on sportrelief.com and an adult’s email address is the only one we ever request and contact (we will only use this email address to communicate specifically about the U16 Giving Page). Please see our Online Safety Tips if you or your child is setting up a Sport Relief Giving Page.  If you would like to fundraise as a family, you could also set up a Group Giving Page.
  • You can help your child with their fundraising by downloading a kids’ sponsorship form.
  • If you are not the child’s parent/guardian and wish to enter them into a Sainsbury’s Sport Relief Games event and/or set them up with a Giving Page, please ensure you have permission from their parent/guardian to do so.

Online Shop Terms and Conditions

Please note that teachers ordering Sport Relief Wristbands for Schools should read the Sport Relief Wristbands for Schools Terms and Conditions.

The following terms and conditions of sale apply to all orders, except Sport Relief Wristbands for Schools, placed with the Sport Relief 2014 online shop (in addition to the Terms of Use, which apply to the use of the site generally). By placing an order for goods you are deemed to have accepted these terms and conditions of sale.

We advise you to print and keep a copy of these terms and conditions for your records. Please note that we may make changes to these terms and conditions from time to time, so please check them each time you use the online shop.

Please note that these terms and conditions do not apply to free fundraising packs or other free materials ordered through the site or to donations added to your order.

 

Purchasing

To purchase goods from Comic Relief through the online shop, you need to complete the online ordering process. Your order is an offer to buy the goods on these terms and conditions of sale. We will send you an email confirming receipt of your order and your order details. Our email is our acceptance of your offer to buy the goods. Worldpay will process your payment on our behalf.

The supply of goods from the online shop is subject to availability. Whilst we will try to inform you if any goods are unavailable before you place an order, we cannot always do this. If this happens, you will be informed by email and you will either not be charged or be refunded for any unfulfilled items.

 

Prices

Prices of all goods available on the online shop are quoted and charged in sterling and, where applicable, are inclusive of VAT at the current rate.

 

Forms of Payment

We accept all major credit and debit cards (except American Express and Electron). Comic Relief cannot accept payment by cash, cheque or postal order for orders placed on the online shop.

 

Delivery

We regret that we are unable to deliver outside of the UK, as the high cost of delivery beyond the UK currently makes such a service uneconomic. Please note that we cannot deliver to PO Boxes. BFPO orders will be sent to the BFPO Head Office in the UK.

Parcels will be dispatched either through Royal Mail or Courier, dependent on the order weight and value. All courier deliveries will require a signature at receipt. A postage and packaging charge (referred to as P&P) is payable on all orders according to the size of the order. This charge will be calculated at the checkout stage of your order, and includes VAT at the current rate.

Any orders placed after Sunday 16th March are not guaranteed to be delivered before the Sport Relief Weekend from Friday 21st to Sunday 23rd March 2014.

 

Cancelling your Order

You have a statutory right to cancel your order by notifying us in writing within 7 working days of delivery. Your right to cancel does not apply:

  • to wristbands ordered through the Sport Relief Wristbands for Schools scheme
  • to goods you have used and which are therefore not in a saleable condition; or
  • to all goods or services, if you are acting in the course of business.

To cancel your order and claim a refund, write to us at the Returns Address below within 7 working days from delivery, heading your letter "Order Cancellation" and providing your name and contact details, your order number and a description of the goods being cancelled. A 'working day' is any day which is not a weekend or a bank holiday.

If you have already received your goods, send them back to the same Returns Address in a saleable condition, using the address label and returns slip provided on the delivery note. We recommend you use registered or recorded delivery to ensure they reach us safely as we will not refund goods not returned. If you do not return the goods, we have the right to collect the goods from you and charge you for the full cost of doing so.

If you wish to cancel before delivery, please email us immediately at shop@sportrelief.com with your name, address and order number. Whilst we will try to cancel the order before it is dispatched, we may be unable to do so. If the goods are delivered you will still need to cancel your order in writing and return the goods as set out above.

We will refund the purchase price to you within 30 days of your cancellation notice (including the original postage and packing we charged you). You are responsible for the costs of returning the goods and this cannot be refunded.

Please note that we are unable to cancel any orders after the 7 working day period unless the goods are faulty (see 'Faulty Goods' below). Your right to cancel is separate from other statutory rights you may have.

 

Faulty Goods

If any goods ordered from us are faulty, please return them using the address label and returns slip provided on the delivery note as soon as possible to the 'Returns Address' below, securely packaged. If we find that the goods are faulty, and you have returned them within a reasonable period, we will refund the purchase price to you (including the original postage and packing we charged you), and your postage and packaging costs for returning the goods (standard recorded delivery). This refund policy does not affect your statutory rights.

 

Replacement Goods

Please note that due to campaign time constraints and stock availability, we cannot guarantee to be able to replace any returned item in time for the Sport Relief Weekend from Friday 21st to Sunday 23rd March 2014.

Donations

We regret that any additional donations made through the ordering process (including Round Pound) are not refundable.

 

Children

You may only order goods through the online shop if you are 18 or over. If you are under 18 years old, please ask your parent or guardian to complete the ordering process.

 

Liability

Comic Relief shall not be liable if we are unable to carry out our obligations (including any delays) due to any circumstances beyond our reasonable control.

Comic Relief shall not be liable for any indirect or consequential losses, or for any business losses (including loss of profits, data, anticipated savings, goodwill or for wasted expenditure) you may suffer as a result of any breach of these terms and conditions of sale.

We do not limit or exclude our liability for death or personal injury caused by our negligence.

 

Re-sale of products

The products sold on this site raise money for Comic Relief, and are not intended for commercial re-sale. Under charity fundraising laws, businesses may not re-sell the products to the general public without the permission of Comic Relief.

 

Governing law and jurisdiction

These terms and conditions of sale shall be governed by and enforced in accordance with the laws of England and Wales. Comic Relief and you both agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.

The following terms and conditions apply to orders for schools and fundraising materials, and are in addition to our Terms of Use and Privacy Policy which apply to the use of this site generally. By ordering materials, you are accepting these terms and conditions.

Please note that we may make changes to these terms and conditions from time to time, so please check them each time you make an order.

All fundraising kits and schools materials are subject to availability.

The material in the kits is provided without any guarantees, conditions or warranties as to its accuracy, quality or relevance.

You must be 16 years or older to order a Fundraising Kit. If you are planning to fundraise or organise any activity for Sport Relief please make sure you read the important information in the Serious Bit.

 

Delivery

We regret that we are unable to deliver outside of the UK, as the high cost of delivery beyond the UK currently makes such a service uneconomic. Please note that we cannot deliver to PO Boxes. BFPO orders will be sent to the BFPO Head Office in the UK.

Parcels will be dispatched either through Royal Mail or Courier, dependent on the order weight. All courier deliveries will require a signature upon receipt.

If you order before 16th January you should receive your pack before the end of January. After this date, we aim to deliver your pack within seven working days from receipt of order (but please wait an additional two working days before querying your order).

Any orders placed after Sunday 16th March are not guaranteed to be delivered before the Sport Relief Weekend of 21st to 23rd March 2014.

Governing law and jurisdiction

These terms and conditions of sale shall be governed by and enforced in accordance with the laws of England and Wales. Comic Relief and you both agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.

Wristbands for Schools - Terms and Conditions:

1. Wristbands cost £1 each. On placing your order you may either pay for your Wristbands in full or pay a deposit of £18 per box of 60 Wristbands (30p per Wristband) with the balance to be paid as soon as possible after Sport Relief.

2. All Wristbands ordered must be paid for in full. We regret we are unable to refund deposits or take back unsold Wristbands.

3. Wristbands must be sold for £1 each. Any money paid over £1 should be treated as a donation and sent to Comic Relief as soon as possible.

4. Each person selling Wristbands under the Wristbands for Schools scheme does so as an unpaid agent of Comic Relief Limited (a wholly owned subsidiary of Comic Relief).

5. Please dispose of any unsold Wristbands so they cannot be reused.

6. On all materials publicising sales of Wristbands you must state: “At least 50p from the sale of each Wristband goes to Comic Relief, registered charity 326568 (England/Wales); SC039730 (Scotland).”

7. Wristbands ordered before 31 January 2014 should be delivered by 14 February 2014. For orders placed after 31 January 2014 please allow 10 working days for delivery. Wristbands for Schools closes on Friday 14 March 2014. Order forms received after this date will not be processed and your cheque will not be cashed.

8. Wristbands are not suitable for children under three years.

9. Orders are subject to availability.

10. P&P includes VAT.

Sport Relief Email Survey Prize Draw and Conditions

  • By entering this prize draw, you agree to be bound by these terms and conditions.
  • To enter this prize draw, you must be a UK resident and aged 16 years or over.
  • The survey prize draw is for the prize of an official Sport Relief 2014 T-Shirt signed by Davina McCall with the prize winner’s name drawn at random.
  • The prize draw commences at 12:00 on 28th March and is open to all who complete the survey before 23:59 on the 6th April 2014, and who submit a valid email address.
  • We will only accept one entry per person, if more than one entry is submitted the entrant will be disqualified.
  • The winner will be chosen at random from all eligible entrants on 10th April 2014 and will receive notification of winning as soon as possible and will be sent their prize by the 21st April 2014.
  • There are no alternative prizes or substitutes.
  • This survey is being conducted for Comic Relief by FieldandFab, an independent research agency. FieldandFab is a member of the Marketing Research Society. All your responses will remain confidential and anonymous.

By entering the Prize Draw you agree that you have read these Terms and Conditions and agree that you will be bound by them.  

Comic Relief registered charity 326568 (England/Wales); SC039730 (Scotland) is the owner/promoter of the Prize Draw operating under the eBay seller name therealcomicrelief.

The Prize Draw will run from 19.00 GMT on Thursday 20th February 2014 until 23.59 GMT on Sunday 31st March 2014.

Participation

Regardless of whether the item sells or not, anyone listing items where a percentage (minimum 10%) goes to Comic Relief will automatically be entered in to the Prize Draw, providing the item is genuine and not counterfeit or otherwise illegitimate. Only one entry is permitted per seller.

You may not list any items under eBay’s prohibited list including, but not restricted to, firearms and weapons; offensive material and prohibited services. See the full policy here:

Comic Relief do not accept financial responsibility for any advanced listings which cost the seller additional fees. However, if you donate 100% of the final sale price to charity, any fees are automatically credited back to the seller.  

This Prize Draw is only open to residents of England, Scotland and Wales You must be aged 18 or over to hold an eBay account and therefore be eligible for the Prize Draw. You cannot use someone else’s account to list an item for entry into the competition.  

In the event that the winner does not, or is unable to, comply with and meet the rules, Comic Relief shall be entitled to disqualify the winner, and select another winner. Comic Relief’s decision shall be final. 

Comic Relief will not be liable for any circumstances beyond its reasonable control including an individual’s inability to access the Prize Draw on eBay due to technical difficulties or otherwise. To the extent permitted by law, Comic Relief does not accept any liability for any loss, damage, claim or costs howsoever arising from or incurred wholly or partly by participation in the Prize Draw (save for death or personal injury arising from negligence).

The prize

One winner will be drawn digitally at random by Comic Relief from all listings made between 19.00 GMT on Thursday 20th March 2014 until 23.59 GMT on Sunday 31st March 2014. 

The winner will be notified by telephone within 30 days of the Prize Draw closing. 

The prize consists of a signed Ian Thorpe t-shirt, ‘Now That’s What I Call Comedy’ DVD, ‘Comic Relief Does Little Britain LIVE’ DVD, JK Rowling ‘Quidditch Through the Ages’ and ‘Fantastic Beats and where to Find Them’ books, a Kimberley Walsh signed Sport Relief t-shirt, a t-shirt from the Plymouth Sport Relief mile in 2010 signed by Tom Daley, Sharron Davies, Katie Hopkins, Heather Fell and Andrew Henderson, a signed Sport Relief t-shirt, headband and photo from Nicholas McDonald and £100 of vouchers to be spent in any Tragus establishment:

Winners cannot claim any cash or other alternative to the prize they have won. The prize is non-transferable. However, Comic Relief reserves the right to change the prize at its discretion and offer an alternative prize of similar value. 

Refunds are at Comic Relief’s sole discretion and will be payable only where Comic Relief deems it reasonable, having regard to all the circumstances.


These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales, whose courts shall be courts of competent jurisdiction.
