This is the official Sport Relief 2008 website. By using or registering with this site, you agree to abide by these Terms of Use and the Privacy Policy. If you do not agree to these terms of use, you may not use this site.

Ownership

This site, including its trade marks, logos, design, text and graphics, is owned by and remains the property of Comic Relief. We may include third party copyright materials and trade marks from time to time, which remain the property of their respective owners. Nothing in these terms of use shall be construed as conferring any licence or right to use any trade mark, copyright or other right of Comic Relief or any third party.

Use of materials

Where we have indicated that you may download materials from this site, you may only download and use them as indicated, or to raise awareness about Comic Relief and Sport Relief 2008. You may not download or use any element of this site for personal gain or commercial purposes.

You may not copy, transmit, store or disseminate any element of this site, unless we have clearly indicated. You may not alter, modify, adapt, reverse engineer, disassemble or create derivative works of any software contained on this site.

Registration and passwords

If you register with us and are asked to provide a password, you agree:

  • to keep your password secure and confidential and not allow anyone else to use your email address or password to access this site
  • not to do anything which would assist anyone who is not a registered user to gain access to any registration area of this site
  • not to create additional registration accounts for the purpose of abusing the functionality of the site, or other users, or to seek to pass yourself off as another user.

Your contributions

If you submit any material (including your photographs, video clips or stories) to us, you agree to grant Comic Relief a perpetual, royalty-free, worldwide, non-exclusive licence to use your contribution in all media. This includes the right to copy, edit, publish, grant sub-licences and exercise all other copyright and publicity rights over the material. If you do not want to grant these rights, please do not submit your contribution to us.

You warrant that the materials you submit are original and that you have the right to grant the above licence. You waive all moral rights in the materials for the purposes above.

Responsibility for use

To the extent permitted at law, Comic Relief does not accept responsibility or liability for any loss or damage that may occur in connection with this site, including any interruption or delays.

Comic Relief does not make any representations and does give any warranties concerning this site, and in particular does not warrant that its contents are virus free. To the extent permitted at law, we do not accept any responsibility or liability for any infection by virus or other contamination resulting from your use of this site.

All software provided by third parties (such as Acrobat Reader and RealPlayer) is the sole responsibility of that third party.

Comic Relief is not responsible for the content of any third party sites linked to or from this site.

Unlawful use

You may only use this site for lawful purposes and you may not inhibit the use and enjoyment of this site by any third party. You agree to abide by all applicable laws, regulations and codes of conduct and to be solely responsible for all things arising from your use of this site. You may not submit, publish, post, distribute or transmit any defamatory, offensive, infringing, obscene, indecent or otherwise unlawful or objectionable material or information.

Actions for unauthorised use

If Comic Relief considers, in its sole discretion, that you have breached these terms of use or demonstrated inappropriate conduct in your use of this site, we reserve the right to: warn you via email and require you to discontinue such conduct; delete any material which you have posted to this site; discontinue your registration to this site or any related service; and/or take other measures, including terminating, suspending or restricting your use of this site. Any action that we take is without prejudice to any of our accrued rights.

Governing law

These terms of use shall be governed by and construed in accordance with English Law and you agree to submit to the exclusive jurisdiction of the English courts.

Revisions of these terms of use

Comic Relief reserves the right to change these terms of use at any time. You will be bound by any such revisions and should therefore visit this page from time to time to review the terms of use.

Online Shop Terms & Conditions

The following terms and conditions of sale apply to all orders placed with the Sport Relief 2008 online shop (in addition to the Terms of Use, which apply to the use of the site generally). By placing an order for goods you are deemed to have accepted these terms and conditions of sale.

We advise you to print and keep a copy of these terms and conditions for your records. Please note that we may make changes to these terms and conditions from time to time, so please check them each time you use the online shop.

Purchasing

To purchase goods from Comic Relief through the Sport Relief online shop, you need to complete and submit the order form. Your order is an offer to buy the goods on these terms and conditions of sale. We will send you an email confirming receipt of your order and your order details. Our email is our acceptance of your offer to buy the goods. Worldpay will process your payment on our behalf.

The supply of goods from the online shop is subject to availability. Whilst we always try to inform you if any goods are unavailable before you place and order, we cannot always do this. If this happens you will be informed by email and you will either not be charged or be refunded for any unfulfilled items.

Prices

All prices of goods available on the online shop are quoted and charged in sterling and, where applicable, are inclusive of VAT. All prices will remain unchanged until Friday 21 March 2008, with the exception of any unexpected price or VAT changes.

Forms of Payment

We accept all major credit and debit cards (except American Express and Electron). Comic Relief cannot accept payment by cash, cheque or postal order for orders placed on the online shop.

Delivery

From the time we receive your order, we aim to deliver your goods to you within 10 working days (but please wait 2 additional working days before querying your order).

The high cost of delivery beyond the UK currently makes such a service uneconomic. However, if you do live outside the UK, you can still place an order for delivery within the UK. Just enter the UK address in the correct page at the checkout. Please note that we cannot deliver to PO Boxes.

Parcels will be dispatched either through Royal Mail or Parceline, dependent on the order’s weight. All Parcel Line deliveries will require a signature at receipt. A processing, postage and packaging charge is payable on all orders according to the size of the order. This charge will be calculated at the checkout stage of your order.

Cancelling your Order

You have a statutory right to cancel your order by notifying us in writing within 7 working days of delivery.

Your right to cancel does not apply:

  • to DVDs, CDs, software or other recordings if you have unsealed them;
  • to goods you have used and which are therefore not in a saleable condition; or
  • to all goods or services, if you are acting in the course of business.

To cancel your order and claim a refund, write to us at the "Returns Address" below within 7 working days from delivery, heading your letter "Order Cancellation" and providing your name and contact details, your order number and a description of the goods being cancelled. A ‘working day’ is any day which is not a weekend or a bank holiday.

If you have already received your goods, send them back to the same Returns Address in a saleable condition, using the address label and returns slip provided on the delivery note. We recommend you use registered or recorded delivery to ensure they reach us safely. If you do not return the goods, we have the right to collect the goods from you and charge you for the full cost of doing so.

If you wish to cancel before delivery, please email us immediately at shop@sportrelief.com with your name, address and order number. Whilst we will try to cancel the order before it is dispatched, we may be unable to do so. If the goods are delivered you will still need to cancel your order in writing and return the goods as set out above.

We will refund the purchase price to you within 30 days of your cancellation notice (including the original postage and package we charged you). You are responsible for the costs of returning the goods and this cannot be refunded.

Please note that we are unable to cancel any orders after the 7 working day period unless the goods are faulty (see ‘Faulty Goods’ below). Your right to cancel is separate from other statutory rights you may have.

Faulty Goods

If any goods ordered from us are faulty, please return them using the address label and returns slip provided on the delivery note as soon as possible to the ‘Returns Address’ below, securely packaged. If we find that the goods are faulty, and you have returned them within a reasonable period, we will refund the purchase price to you (including the original postage and package we charged you), and your postage and package costs for returning the goods (standard recorded delivery). This refund policy does not affect your statutory rights.

Replacement Goods

Please note that due to campaign time constraints and stock availability, we cannot guarantee to be able to replace any returned item in time for the Sport Relief Weekend on Friday 14th to Sunday 16th March 2008.

Children

You may only order goods through the online shop if you are 16 or over. If you are under 16 years old, please ask your parent or guardian to complete the ordering process.

Liability

Comic Relief shall not be liable if we are unable to carry out our obligations (including any delays) due to any circumstances beyond our reasonable control.

Comic Relief shall not be liable for any indirect or consequential losses, or for any business losses (including loss of profits, data anticipated savings goodwill or for wasted expenditure) you may suffer as a result of any breach of these terms and conditions of sale.

We do not limit or exclude our liability for death or personal injury caused by our negligence.

Governing law and jurisdiction

These terms and conditions of sale shall be governed by and enforced in accordance with the laws of England and Wales. Comic Relief and you both agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.

Security and Privacy

When you place your order you are automatically connected to our secure server using SSL encryption technology. This ensures that the information you send cannot be read by anyone apart from our e-commerce team. To check you are in a secure area of our site please look at the bottom of your browser and you will see a closed padlock. When you submit your order you are authorising Comic Relief to use your personal details to fulfil your order (through Worldpay and DSI). For further details, please see our privacy policy and the questions set out on the order form page regarding the use of your personal details. In the event of there being a problem with your order we will communicate with you via e-mail, telephone or letter.

Online Sponsorship and Donation

The following terms and conditions of apply to all sponsorship or donation transactions given using the Sport Relief 2008 online service.

All sponsorship is given on the basis that the individuals involved are attempting to complete a challenge or task; payment / charges are not conditional upon the challenge or task being completed.

All donations and sponsorships are non-refundable. At the discretion of the Trustees of Comic Relief there may be situations where transactions will be refunded in full or part (such situations include fraudulent or unauthorized use of credit cards). Comic Relief reserves the right to charge an administration fee for refunds should it need to.

Community Rules

You must follow these rules when participating in the Fundraisers' Forum or creating / updating your Online Fundraising Page on www.sportrelief.com:

  • Your contributions must be civil, polite and tasteful.
  • No disruptive, offensive or abusive behaviour, unlawful or objectionable content. This includes any material which might be defamatory, abusive, threatening, obscene, profane, or sexually or racially offensive. It also includes any material which is aggressive, argumentative or likely to be construed as bullying.
  • No spamming or off-topic material: we won't allow the repeated submission of similar contributions especially if they're boring, so please don't submit your contribution more than once, and please don't contribute off-topic material in subject-specific threads or areas.
  • No advertising or other commercial messages or content.
  • No impersonation - unless you're at least as good as Rory Bremner.
  • No inappropriate user names. This includes anything vulgar or offensive - and the cunning use of £^%$ to make people think you're being vulgar.
  • You may not refer to other websites, or post urls. If you have a helpful address to share, inform the Comic Relief community members on fundraising@sportrelief.com and they will promote it if appropriate.
  • You may not use multiple logins to try to disrupt the community or annoy other users – you’ll only end up forgetting all the passwords and login details anyway – so save yourself the hassle.
  • Please be patient as users of all ages and abilities may be taking part in the community.
  • IMPORTANT: Do not post any personal information about yourself or anyone else (for example your telephone number, home address or email address).

If you wish to promote an event you are organising please use your Online Fundraising Page and be aware that you can set some of your details to be publicly accessible in that environment. Should you find you need to review or remove any of these details you can easily do so by logging into your page and changing your profile settings.

The views expressed within the Fundraisers' Forum or an Online Fundraising Page are those of members of the public and are not necessarily those of Comic Relief.

The Fundraisers' Forum or Online Fundraising Page have been created for use by supporters aged 16 and over. Content and forums / discussions for younger people are supported by our partners at CBBC. Please visit their sites for more information.

If you breach these rules, you will be sent an e-mail which informs you why your contribution has been edited, removed or was not posted. This mail may include a warning that continuing to break the rules may result in action being taken against your account.

If the breach is serious or persistent, we may suspend or block your account without warning and may use whatever information is available to us about you to stop the breaches. This may include informing relevant third parties such as your employer, school or e-mail provider about the breaches.

Comic Relief reserves the right to delete any contribution, or take action against any account, at any time, for any reason.
