General terms and conditions

You can donate to Sport Relief by texting the below Keyword to the relevant number (the ‘Short Code’). Each text message you send will result in a donation to Sport Relief of the amount listed in the ‘Donation Value’ column. For example, by texting “GIVE” to 70210, you will donate £10.

  • As well as the relevant Donation Value, each text message will incur your standard network message charge (based on your service provider rates). This service can only be used from a UK mobile and does not include Channel Islands or Isle of Man mobile networks. If you donate using this service from a UK mobile abroad you may incur additional network charges.
  • Where calls to donate are associated with challenges, your donations are independent of the success or failure of the challenge.
  • The following mobile network operators have waived their charges in order to allow the full Donation Value of the reply confirmation text message (described below) to go entirely to support Sport Relief: 3, O2, EE, Virgin and Vodafone. In addition, HMRC has confirmed that no VAT should be charged on these donations.
  • You can send a text message between 00:00 on the date the Keyword and Short Code combination go ‘Live’, as listed in the above table, and 23.59 on the Closing Date, as listed in the above table. Please ensure you spell the Keyword correctly and send your text message to the correct Short Code.
  • If your Keyword and Short Code are valid and your text message is received within the specified times and dates, you will be charged the applicable Donation Value via a reply confirmation text message and your donation will go to Sport Relief (with the exception of Vodafone customers, who will be charged the Donation Value directly via their bill). It may take some time for you to receive the confirmation text message. Please wait until you receive it. Unless a cap applies (see below) each valid text you send will result in a charge of the Donation Value plus your standard network message charge, regardless of when you receive your confirmation text message. Any repeat texts will result in repeat donations.
  • If you are a UK taxpayer, we can claim an additional 25p in Gift Aid from the Government for every £1 you donate. And it doesn't cost you a penny - just give us your details! To help us claim this, we may send you a follow up text to ask if you want to claim Gift Aid on your donation. For us to claim Gift Aid, you must pay UK income or capital gains tax this year (this does not include VAT or council tax) at least equal to the amount reclaimed on all your charitable donations. Find out more about Gift Aid on comicrelief.com. We may include a link in the text message, and if you follow the link you will be taken to a website to complete the Gift Aid declaration.   • Your information will be collected by Fonix Mobile Limited on behalf of Charity Projects (operating as Comic Relief) and will only be used for processing your donation, providing receipts, and in order to help analyse our income. It will not be used for any other purposes. Any additional information provided as part of the Gift Aid declaration will only be used for the purpose of claiming Gift Aid. Your data will only be used by Comic Relief and our agents and will NOT be passed onto any third parties. Please see Comic Relief’s privacy policy.
  • If your Keyword or Short Code is invalid, or if your message is received outside the times and dates of the service, you may not receive a confirmation text message but may still be charged your standard network message charge. If no confirmation text message is received, you will not be charged the Donation Value as you will not be donating to the charity. However, if you receive the confirmation text message then you may still be charged the Donation Value, in which case your donation will still be made to Sport Relief.
  • You can donate by text to each Short Code up to a maximum total donation of £30 each day from the same mobile telephone number (midnight to midnight). If you try to donate more than that in a day using the same Keyword from the same mobile, you will still be charged your standard network rate, but will not be charged the Donation Value for a confirmation text message and will not be donating to Sport Relief. For the avoidance of doubt this maximum is placed on the text messages sent with the same Keyword to the same Short Code.
  • If you would like to contribute more money to Sport Relief, you can donate online. Any donations to Comic Relief, including donations via text, are non-refundable.
  • All supporters must obtain permission from the bill payer before sending a text message. If you are under 16 years old, you must have your parent or guardian’s permission to send a text donation to us.
  • Comic Relief, Sport Relief, BBC and their sub-contractors, subsidiaries and/or agencies cannot accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any telephone network or line, system, server, provider or otherwise which may result in any text being lost or not properly received.

These terms and conditions apply to your use of the SMS text donation service (the “Donation Service”) for Sport Relief 2018 (the “Appeal”).

A. Donations to Sport Relief 2018

Donations to the Appeal are for the benefit of Charity Projects (operating as Comic Relief) (the "Charity”).

Sport Relief is an initiative of Charity Projects, operating as Comic Relief, a charity registered in England & Wales (326568) and Scotland (SC039730). More details about the Charity and its activities are available at sportrelief.com.

All sums raised by the Appeal during the donation period specified below. Any administration fees, including but not limited to applicable network operator fees and VAT, will be paid by the BT.

The Donation Service is operated by British Telecommunications plc (“BT”) via its sub-contractors Cymba &CLX .(“Sub-contractors”).

B. Who can donate

You must be aged 16 years or over and resident in the UK to use the Donation Service. Donations are valid only from UK registered mobile phones operating in the UK and does not include Channel Islands or Isle of Man mobile networks. If you donate using this service from a UK mobile phone abroad you may incur additional network charges. You must be aged 16 or over and must have prior parental or legal guardian permission before using the Donation Service.

Please ask permission from the bill payer before using the Donation Service.

C. Donation period opening and closing times

The donation period for donations made by SMS text message opens on 02/10/2017 and closes on 10/10/2017 (the “donation period”). You can send a text message between 00:00 on the start date of the donation period, and 23.59 on the end date of the donation period. Donations made or received outside of the donation period may not be included in the Appeal but you may still be charged as set out below.

D. How to donate

You may make a donation of £5 by sending a text with the ‘keyword’ ‘SPORT’ to 70800 (the ‘short code’) during the donation period. Please ensure you spell the keyword correctly and send your text message to the correct short code.

If your keyword and short code are valid and your text message is received within the donation period, you will be charged £5 via a reply confirmation text message and your donation will go to the Appeal (with the exception of Vodafone customers, who will be charged the £5 directly via their bill). It may take some time for you to receive the confirmation text message. Please wait until you receive it.

There is no limit on the number of times you may make a donation via SMS text but there is a daily (midnight to midnight) limit of £30 on text donations to the same short code from the same telephone number. Further text donations will not be accepted if you have already donated £30 by SMS text to the same short code from the same telephone number in one day.

If your keyword or short code is misspelt/misdialled, or if your message is received outside the donation period, you may not receive a confirmation text message but may still be charged your standard network message charge. If no confirmation text message is received, you will not be charged the donation amount as you will not be donating to the Appeal. However, if you receive the confirmation text message then you may still be charged the donation amount, in which case your donation will still be made to the Appeal.

No refunds are available for the cost of any SMS text made or for any misdialled short codes or misspelt keyword.

If you do not have sufficient credit in your mobile account or if you have sufficient credit for a standard network rate message but not for your donation or if you are otherwise unable to access the shortcode because of any settings on your mobile account your donation may be unsuccessful.

Please note that SMS text donations are available in the UK only.

E. Gift Aid

If you are a UK taxpayer, we can claim an additional 25p in Gift Aid from the Government for every £1 you donate. And it doesn't cost you a penny - just give us your details! For us to claim Gift Aid, you must pay UK income or capital gains tax this year (this does not include VAT or council tax) at least equal to the amount reclaimed on all your charitable donations. F. Data and marketing

BT and its subcontractors and the Charity will only use your personal data to process your donation, providing receipts, and in order to help analyse our income, and will not be used for any other purpose or passed onto any third parties. Any additional information provided as part of the Gift Aid declaration will only be used for the purpose of claiming Gift Aid. Please see Comic Relief’s Privacy Policy.

G. General

T and their Sub-contractors and the Charity may suspend, withdraw or re-set the Donation Service (or any part of the Donation Service) in their sole discretion at any time and they do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any telephone network or line, system, server, software provider or otherwise which may result in any donation not being properly registered or recorded.

BT and their sub-contractors and the Charity cannot promise that the Donation Services and systems will be free from errors or omissions nor that it will be available uninterrupted and in a fully operating condition. The Donation Services and systems may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the reasonable control of BT and the Charity. BT and the Charity will not be liable to you or to any other person in the event that all or any part of the services or system is discontinued, modified or changed in any way.

Trademarks, service marks or logos that appear in relation to the website, Donation Service and/or its associated services, in particular (but not exclusively) those of BT, the Charity and/or BT's subcontractors, are the property of their respective owners and are likely to be registered trademarks and subject to restrictions as to their use. They must not be used without the express permission of the trade mark owner. All content on the website and its associated services is owned by BT, the Charity, BT's subcontractors or other original providers, and is protected by the applicable intellectual property and proprietary rights and laws. You may use the Donation Services exclusively for your personal, non-commercial use provided you do not alter it or remove any copyright, trade mark or other proprietary notice. No other use of the Donation Services' content is permitted without the express prior permission of BT, and, where applicable, the copyright holder.

BT and its subcontractors and the Charity shall not (and nothing in these terms and conditions shall) act to exclude or limit their own liability for death or personal injury resulting from its negligence, fraud or any other liability which may not by applicable law be excluded or limited. You agree that your use of the Donation Services is on an "as is" and "as available" basis and that your use of the Donation Services is at your sole risk. BT and its subcontractors and the Charity cannot guarantee continuous uninterrupted or secure access to the Donation Services and operation of the Donation Services may be interfered with by numerous factors outside of their control. On that basis, except as expressly set out in these terms and conditions, BT and its subcontractors and the Charity shall not provide conditions, warranties or other terms in relation to the Donation Services to the extent permissible by law.

Subject to exceptions listed above, in no event shall BT or its subcontractors or the Charity be liable (whether for breach of contract, negligence or for any other reason) for any loss or damage which you may claim to have suffered by reason of your accessing and use of the Website, the Donation Services and its associated services.

These terms and conditions are available in English only and shall be exclusively governed by and construed in accordance with the laws of England. The Charity and BT may update and amend these terms from time to time and any changes will be posted on the Charity’s website.

The Charity and BT will not file or store a copy of these terms for each interaction or transaction by you via the BT Website. We therefore recommend that you print and store or save a copy of these terms for future reference.
